DOL’s Persuader Rule Put on Hold by District Court

A federal judge in Texas temporarily blocked implementation of the Labor Department’s “persuader” rule after finding that business groups likely will succeed on their statutory and constitutional challenges to the measure (Nat’l Fed’n of Indep. Bus. v. Perez, N.D. Tex., 16-66, preliminary injunction 6/27/16).

Granting a preliminary injunction against the rule, Judge Sam R. Cummings said the National Federation of Independent Business and other challengers probably will prevail on the merits of their challenges to the rule, which was scheduled to be implemented beginning July 1.
