Dollar Tree Partly Defeats Ex-Store Manager’s Leave Bias Claims

Dollar Tree Stores Inc. secured dismissal of claims that it retaliated against a former manager who sought time off to care for her autistic son, but the worker’s leave interference claim is headed for trial.

The worker lacks evidence that the discount chain fired and then refused to rehire her because she invoked her Family and Medical Leave Act rights, the US District Court for the Middle District of Pennsylvania said. But it’s up to a jury to decide whether Dollar Tree’s third-party claims manager denied her benefits the the law entitled her to, the Wednesday opinion said.
