DOL Wins $15 Million Ruling Against Rule-Fighting Home Care Firm

The US Labor Department secured a pretrial victory in an overtime enforcement suit against one of three home-care firms that have separately been challenging the agency’s wage exemption rule revision.

Americare Healthcare Services LLC aides are employees, and there’s no genuine dispute that the company can’t claim a Fair Labor Standards Act exemption to avoid paying them for working overtime, the US District Court for the Southern District of Ohio said. A recent US Supreme Court opinion upending four decades of agency deference doesn’t change the validity of the 2013 DOL rule at issue, the Thursday opinion said.
