The US Labor Department can intervene in a case where a large bakery company is threatening to seek restitution against workers who allege they were misclassified and owed backpay, a federal judge in Vermont ruled.
Acting Labor Secretary Julie Su’s interest in the case—protecting the public’s interest in the enforcement of the Fair Labor Standards Act—warrants allowing the department to step into the case to oppose Bimbo Bakeries USA Inc.’s counterclaim, US District Judge William Sessions said in his Monday order.
