The US Labor Department has officially removed from its regulations a Biden-era rule requiring employers to pay tipped workers full minimum wages for their downtime, following a federal appeals court’s decision to vacate the rule earlier this year.
In a technical amendment set to publish in the Federal Register Dec. 17, the Wage and Hour Division said it was eliminating language from its dual jobs regulation that limited when employers could pay tip-earning employees lower than the minimum wage when they weren’t actually earning tips.
