The Department of Labor is not opposing a motion requesting a federal judge vacate a key Biden administration 401(k) rule, dealing a near-final blow to the regulation as the Trump administration seeks to re-write it.
The American Council of Life Insurers and eight other trade groups that had sued to challenge the rule filed an unopposed motion on Monday in US District Court for the Northern District of Texas asking a judge to vacate the rule in its entirety.
