DOL Halts Enforcement of Home Care Minimum Wage, OT Protections

The US Labor Department is no longer enforcing a rule expanding minimum wage and overtime protections to home health aides, as the agency works remove the regulation from its books.

A Field Assistance Bulletin to Wage and Hour Division staff dated July 25 instructs investigators to suspend enforcement of all provisions included in a 2013 rule that restored basic minimum wage requirements for live-in domestic workers and direct care workers that provide “companionship services” for elderly or disabled people.
