DOL Beats Missouri Nursing Home’s Bid for Wage Win on Second Try

The US Labor Department defeated a nursing home operator’s bid to end a lawsuit alleging break violations when a district judge took another look after the Eighth Circuit nixed a prior victory for the employer.

Levering Regional Health Care Center LLC and its healthcare management company sought summary judgment on the labor agency’s claims that they didn’t pay employees who worked during meal breaks. But the DOL provided enough evidence of willful Fair Labor Standards Act violations to go to trial, the US District Court for the Eastern District of Missouri said Monday.
