District Court Tosses Workers’ Claims For Severance Benefits, Fiduciary Breach

A proposed class of former employees of United States Enrichment Corp. cannot proceed with a claim for severance benefits, the U.S. District Court for the Southern District of Ohio held Oct. 11 (Bailey v. United States Enrichment Corp., S.D. Ohio, 2:11-cv-00554-PCE-NMK, 10/11/12).

Judge Peter C. Economus found that USEC’s denial of severance benefits to workers who were re-employed under substantially equal conditions following a reduction in force constituted reasonable interpretation of plan terms.

The court also dismissed the workers’ claims of fiduciary breach and interference with attainment of rights under the Employee Retirement Income Security Act.
