A Pennsylvania federal court denied summary judgment to Pennsylvania American Water on the claims of a 60-year-old plant operator that he was discriminatorily discharged due to his age, in violation of the Age Discrimination in Employment Act and state law, ruling that the operator provided enough evidence that his age was a determinative factor in his discharge, including the hiring of much younger operators afterwards, and not discharging a younger operator under comparable circumstances.
