Dignity Health fended off class status, for now, in a suit alleging it failed to compensate thousands of employees for documenting patient information while off-the-clock, as a federal court in California said Tuesday the plaintiffs failed to show their claims can be established with common proof.
Wendy O’Donnell and Ana Jara raised class claims, alleging Dignity Health and Dignity Health Medical Group Nevada LLC violated the federal Fair Labor Standards Act, California’s Unfair Competition Law, and Nevada labor law. Dignity required preapproval of overtime and systematically understaffed its facilities, which forced employees to perform certain necessary tasks off-the-clock, they alleged. ...
