Diamond Resorts Workers Get Partial Wins in Overtime Pay Suits

Diamond Resorts International Marketing Inc. failed to fully compensate concierges, marketing supervisors, and vacation counselors and failed to show they are exempt workers under federal labor law, the District of Nevada ruled.

The company and affiliate West Maui Resorts Partners LP didn’t show the workers fall under a “retail or service establishment exemption” recognized under the Fair Labor and Standards Act, which would have relieved them of the obligation to pay the workers for overtime hours worked, the court said.
