Diakon Delivery Drivers Land First Nod for Wage Suit Settlement

Diakon Logistics and delivery drivers who say it misclassified them as independent contractors secured a federal judge’s initial approval for a $2.1 million deal to end their wage-and-hour dispute.

The settlement covers approximately 285 people who drove for the delivery and installation firm over a 14-year period and represents roughly 63% of the damages they say they’re owed for improper pay deductions, the workers told the US District Court for the Northern District of Illinois. Judge Jeffrey I. Cummings gave the deal preliminary approval in a four-page order docketed Aug. 8.
