DHS Temporarily Blocked from Nixing Burmese Migrant Protections

A federal judge in Chicago temporarily blocked the termination of deportation protections for about 4,000 Burmese immigrants before it took effect Monday.

Several Burmese nationals were likely to succeed with claims that the Department of Homeland Security didn’t meet procedural requirements to terminate Temporary Protected Status for Myanmar, also known as Burma, Judge Matthew F. Kennelly of the Northern District of Illinois found.

The December cancellation—like other TPS decisions by DHS challenged in courts—didn’t appear to follow requirements for review of country conditions or consultation with other federal agencies, he said.
