The Department of Homeland Security is once again adjudicating green card and immigrant visa petitions from foreign investors that had been in limbo since the expiration last year of an investor visa program, the agency said in a federal court filing.
DHS is facing a lawsuit over its guidance issued last month apparently rescinding approvals previously granted to existing investor visa enterprises before the EB-5 regional center program lapsed last year. Congress reauthorized the program in March.
