Denver Fails to Ax Firefighter’s Retaliation Claim From Wage Row

Denver lost its bid to trim retaliation allegations from a lawsuit claiming it it stiffed probationary firefighters on overtime pay for their extra training hours.

The Colorado capital argued that the worker who sued on behalf of a proposed Fair Labor Standards Act collective didn’t allege Denver took any adverse employment actions against him after he asked about overtime. But telling him that any further inquiries about extra compensation would be treated as insubordination is enough to state a retaliation claim under the FLSA, the US District Court for the District of Colorado said.
