Delta Worker Lacks Job Bias Claim Over Passenger’s Racist Remark

Delta Air Lines Inc. was properly granted dismissal of a Black flight attendant’s lawsuit alleging she was suspended and then fired for complaining about a passenger’s racist comment and a pilot’s handling of the situation, a divided Second Circuit ruled Thursday.

The comment allegedly was directed at Clara Leroy while a flight she was working was boarding, but it didn’t amount to an employment practice by Delta and thus fell outside the reach of the New York City Human Rights Law, the court said by a 2-1 vote.
