Delta Air Lines Fights Off Worker’s Overtime, Break Pay Claims

Delta Air Lines Inc. won a reprieve from a lawsuit alleging it failed to pay workers in Washington state for all of their hours or provide them proper break periods.

The factual allegations in the proposed class complaint are “too sparse to state a claim” against the airline, the US District Court for the Western District of Washington said. However, the worker who filed the suit can put together an amended version “because the defects are likely curable,” Magistrate Judge S. Kate Vaughan said Monday.
