Deals to Keep Discrimination Secret Barred by NJ High Court (1)

Settlements in New Jersey can’t stop workers from talking about alleged discrimination, harassment and retaliation, the state Supreme Court ruled Tuesday in a decision that limits employers’ ability to bargain away criticism by former employees.

Even though a former Neptune Township Police Department sergeant signed a deal promising that she wouldn’t disparage her former department, she can tell the media—and anyone she chooses—about what mistreatment she believes she suffered on the job. State law bars any provision that has the affect of silencing workers regarding statements of employers’ discrimination, the unanimous high court ruled.
