Former Drug Enforcement Administration agents claiming the agency wrongfully terminated them after they refused to cooperate in an investigation initiated by their own complaints of misconduct lost their appeal Thursday of a lower court ruling granting summary judgment in favor of the agency.
The U.S. Court of Appeals for the Fourth Circuit affirmed the judgment of a trial court, concluding that Darek and Lisa Kitlinski offered “no evidence that the DEA terminated their employment for any reason other than their conduct” during the Office of Professional Responsibility’s investigation into their claims.
