The Department of Homeland Security followed standard operating procedures when terminating a DACA recipient’s status for a second time in December, a federal district court said April 12. The recipient had lost his status prior, only to have it reinstated by a federal court.
The agency also didn’t violate Alberto Luciano Gonzalez Torres’ due process rights because it gave him notice and the opportunity to respond before making a final decision on his status under the Deferred Action for Childhood Arrivals program, Judge Jeffrey T. Miller of the U.S. District Court for the Southern District of California said.
