CSX Transportation Beats Family and Medical Leave Act Claims

CSX Transportation Inc. won dismissal of claims that it violated a railroad engineer’s Family and Medical Leave Act rights, after the Northern District of Alabama found the company had a legitimate reason for suspending him for improper use of his FMLA benefits.

The company suspended Howard Adams after finding that his pattern of FMLA usage over holidays and weekends, and his previous FMLA warnings in 2016 and early 2017, showed that he improperly used his benefits to avoid working on Christmas 2017.
