Cracker Barrel Workers’ Broad Collective Nixed in Wage Suit (1)

Servers at Tennessee-based Cracker Barrel Old Country Store Inc.'s locations across the US can’t automatically join a collective action over wages in Arizona because they didn’t work in the state, the Ninth Circuit said Tuesday.

The Cracker Barrel workers who filed the suit in Arizona aren’t the only ones who must establish that the federal district court there has the power to hear their Fair Labor Standards Act claims against the company, the US Court of Appeals for the Ninth Circuit said.
