A North Carolina federal court said it could no longer hear a minimum wage and overtime collective action after the only representative plaintiff in the case bowed out of that role.
The court lost jurisdiction over the Fair Labor Standards Act claims against Capstone Logistics when Tyler Hood could no longer serve as representative plaintiff for personal reasons, Judge Matthew Orso ruled Wednesday.
The decision, for now, brings to a close a lawsuit that began in 2022 and could have waded into a split over whether FLSA opt-in plaintiffs’ claims should be restricted to courts where they have state-specific ties. ...
