A federal judge in Alaska Dec. 17 conditionally certified a Fair Labor Standards Act collective action potentially covering 60 sales employees at Alaska Communications Systems Group Inc.'s Anchorage location (Peterson v. Alaska Commc’ns Sys. Grp., Inc., D. Alaska, 3:12-cv-00090, order 12/17/14).
Judge Timothy M. Burgess of the U.S. District Court for the District of Alaska found that Laura Peterson satisfied the “fairly lenient” standard for the first of two certification stages, which requires a modest factual showing that the sales employees were “subject to a common policy or plan that violated the law.”
