Corning Wins Bias Suit Brought by Stuttering Worker (1)

Corning Inc. didn’t discriminate or retaliate against an employee with a stutter, a federal judge has ruled.

Joseph McIntyre, then a line technician, accused the company of denying him a spot as an aviation mechanic in its Aircraft Operations department because of his stutter. He brought a litany of claims against Corning, including discrimination, a hostile work environment, and retaliation.

But his disability discrimination claims were undermined by “several instances” where McIntyre’s deposition testimony contradicted his affidavits and his EEOC complaint, Judge Charles Siragusa said May 16 for the U.S. District Court for the Western District of New York.
