ConEd Worker Fired Over Drug Testing Can Pursue Job Bias Claims

Consolidated Edison Co. of New York must face a former employee’s job discrimination claims regarding drug testing that resulted in his termination, the New York Appellate Division ruled.

But the company was correct that Gary Mouscardy may only collect for alleged bias that occurred within three years of when he sued under the New York State Human Rights Law and the New York City Human Rights law in February 2008, the appeals court said Wednesday. A three-year statute of limitations applies to both laws, it said, partially reversing a lower court’s denial of summary judgment to ConEd.
