ConEd Unit Loses Bid to Ax Some Wage Claims From Worker Lawsuit

A ConEd subsisiary can’t ditch allegations that it ran afoul of federal, state, and New York City wage laws, said a judge who also gave the workers tentative permission to proceed as a collective.

Consolidated Edison Co. of New York Inc. convinced the court to address the merits of some claims after a magistrate judge recommended deferring a closer look. But instead of ruling that those claims fail, Judge Jennifer L. Rochon of the US District Court for the Southern District of New York on Wednesday said they’re sufficient to move forward.
