Conagra Unit Beats Worker Bid to Send Wage Case to State Court

A Conagra Brands Inc. subsidiary convinced a federal judge to reject a worker’s attempt to get a proposed class action sent back to the state court where she initially filed her wage claims.

ConAgra Foods Packaged Foods LLC demonstrated that potential damages for the unpaid overtime claim on it own satisfy the Class Action Fairness Act’s requirement that there be more than $5 million in controversy to remove a case filed in state court to a federal forum, the US District Court for the Eastern District of California said.
