Comcast Race Bias Case at High Court Could Ripple Into Workplace

The outcome of a U.S. Supreme Court case that grapples with a standard to determine whether a race discrimination claim can move forward will have implications on employment litigation throughout the country, likely making it harder for workers to win in court.

The justices agreed on June 10 to take up Comcast Corp. v. National Association of African American-Owned Media and consider whether a Reconstruction-era law, known as Section 1981 of the 1866 Civil Rights Act, should require the association to prove that race was the key reason for not carrying its programming.
