Judge Denies Comcast Bid to Move Whistleblower Case From DOL (1)

Comcast Corp. lost its bid to move its fight against company whistleblowers to a federal court, instead of pursuing it before a US Labor Department in-house judge.

The Tuesday Virginia federal court decision is one of the first rulings to address the DOL’s administrative law judges’ authority following the US Supreme Court’s ruling in SEC v. Jarkesy, which said defendants have a constitutional right to make their case to a federal jury on matters similar to common law and when a federal agency is seeking financial remedies.
