Colgate Student Fails to Show Bias in Sex Misconduct Expulsion

Colgate University defeated an expelled student’s claims that an anti-male bias tainted his sexual misconduct investigation and hearing process, the U.S. Court of Appeals for the Second Circuit ruled.

A trial judge also properly barred John Doe, who allegedly assaulted three female students, from offering in his defense the testimony of a law professor who criticized two “modes of thinking” she said permeate, and hinder, the handling of sexual misconduct complaints brought under Title IX of the 1972 Educational Act, the appeals court said Jan. 15.
