A former Clean Harbors Environmental Services Inc. employee lost his bid to revive claims that he was discriminated against and harassed because he’s Black and fired for opposing racial bias.
Gilbert Edwin lacked evidence that his termination was motivated by something other than his positive test for marijuana, the US Court of Appeals for the Fifth Circuit said. Edwin was drug tested after he informed the company that he was ready to return from four months of leave following a workplace injury, the court said.
