Citizens Must Face Trial in Anxiety Suit, Judge Says (Correct)

Citizens Bank NA should be denied its motion for summary judgment in a suit filed on behalf of an employee who resigned after the bank denied his request to be reassigned to a position that didn’t require telephone contact, a Rhode Island magistrate judge said.

A reasonable jury could conclude that Citizens never offered William Lescault leave as an anxiety accommodation, and that its offer to continue the interactive process was “meaningless,” Magistrate Judge Patricia A. Sullivan said in her report and recommendation March 10.
