Circle K Worker Fired for Resisting Shoplifter Gets Case Revived

A former Circle K Stores Inc. cashier who lost her job after she declined to hand over cigarettes to a man wielding a knife can try again to challenge her firing, a federal appeals court said Tuesday.

The trial judge should have examined whether the worker actually acted in self-defense and if that’s why Circle K fired her, the US Court of Appeals for the Tenth Circuit said in an unpublished opinion. It vacated a lower court ruling that said Colorado law wouldn’t recognize an exception to at-will employment for employees fired for acting in self-defense.
