Circle K Ex-Workers Get Age Bias Promotion Denial Case Revived

Three former Circle K Stores Inc. workers provided enough evidence of age-based promotion denials to land another shot at their bias claims, a federal appeals court said Friday.

The trio of dealer business managers all sought promotion to a regional director role but didn’t get the chance to apply before the convenience store chain announced it had selected a younger worker for the job. Their lawsuit should have survived summary judgment, the US Court of Appeals for the Ninth Circuit said, reversing a lower court ruling in Circle K’s favor.
