CIOX Health Fails to Ditch Ex-Worker’s Disability Bias Lawsuit

CIOX Health LLC must defend against a former employee’s claims of disability discrimination and interference with medical leave rights after a federal judge declined to dismiss the case.

The worker adequately alleged that the health care information solutions company constructively discharged her after she faced disability bias, the US District Court for the Southern District of Mississippi said. She also sufficiently pleaded that CIOX knew her disability-related absences potentially fell under the Family and Medical Leave Act but didn’t tell her she was eligible for protected time off, the Tuesday order said.
