Christian Group Not Subject to EEOC Pregnancy Rule, Judge Says

A Missouri federal court said the EEOC cannot compel a Christian education group to follow the agency’s rule requiring certain accommodations for workers who seek abortions.

Judge Roseann A. Ketchmark granted a permanent injunction requested by both the Equal Employment Opportunity Commission and the Stanley M. Herzog Foundation that affirms the agency can’t enforce its Pregnant Workers Fairness Act rule against the organization.

The Republican controlled EEOC is likely to modify the Biden-era PWFA rule. Current Chair Andrea Lucas has voiced opposition to its scope and the commission has shifted away from defending it in court.
