Chemical Council Settles GHS Lawsuit On Combustible Dust; Other Cases Continue

Although the American Chemistry Council settled its legal dispute with the Labor Department’s Occupational Safety and Health Administration over combustible dust requirements in the new hazard communication standard, the objections of other industries are unresolved (Nat’l Oilseed Processors Ass’n v. DOL).

As a result of the ACC settlement, OSHA made public April 8 a guidance letter on how the hazard communication standard applies to combustible dust. The letter, dated March 25, addresses ACC questions about combustible dust in hazard statements, safety data sheets, labels on shipped containers, and workplace labels.
