The National Labor Relations Board ruled that its Biden-era framework to discourage employers from violating labor law before union elections didn’t create a filing deadline for representation petitions.
Cemex Construction Materials Pacific LLC instructs employers to recognize a new union or “promptly” file for an election when the union asks for recognition based on a majority of workers showing support. Although Cemex indicated that promptly normally means two weeks, it didn’t create an enforceable time limit, the NLRB held Wednesday.
