PBM Enterprises, Inc. is denied summary judgment on a hookah bar server’s collective Fair Labor Standards Act overtime wages and unlawful tip-pooling claims, a federal court ruled, where she allegedly regularly worked 45 to 55 hours a week, and was paid only tips without overtime, fact issues exist regarding overtime hours worked and management participation in tip pooling, but FLSA minimum wage and retaliation claims were defeated as she earned over minimum wage through service charges.
