A class of employees of two restaurants, The Bao and Uluh, which shared ownership and a central office, were granted summary judgment in part on their allegations of violations of the Fair Labor Standards Act and the New York Labor Law, a federal district court ruled, where the workers were employees of the restaurants that operated as a single enterprise, the enterprise failed to give proper notice of tip credit to tipped employees, and instituted unlawful tip pools that included management.
