Restaurant Life LLC’s partial motion to dismiss the Florida Minimum Wage Act claims of a former employee, alleging the restaurant didn’t give employees proper notice of tip crediting and made them share tips with managers and owners must be denied, where the act permits class actions, a notice doesn’t have to itemize wages purportedly due to each class member, and a FMWA defendant can’t avoid a class suit by paying the wages owed only to the plaintiff, a Florida federal district court ruled.
