An Ohio federal district court granted a motion for equitable tolling of the statute of limitations under the Fair Labor Standards Act filed by an employee on behalf of himself and similarly situated employees against Paycor, Inc., finding that the extraordinary two-and-a-half year delay in ruling on his motion for court-authorized notice, combined with the Sixth Circuit’s heightened “strong likelihood” standard for determining whether potential plaintiffs are similarly situated, warranted tolling from the date the plaintiff filed his motion for court-authorized notice until notice is issued to the putative collective.
