A California federal district court granted a motion to remand to state court filed by a director of emergency services who brought claims against Belfor USA Group, Inc. and its regional manager under the California Labor Code, Business and Professions Code, and Industrial Welfare Commissions Wage Orders for misclassification, unpaid overtime, and denial of meal and rest breaks, finding that the regional manager could potentially qualify as a “managing agent” under California Labor Code and thus wasn’t fraudulently joined, defeating diversity jurisdiction.
