The Hawaii state supreme court reversed the finding of the state intermediate appellate court that Mauna Kea Resort LLC didn’t violate state law when it didn’t fully disclose to customers beforehand that it didn’t provide services charge payments to employees as tip income, ruling that the statute required the resort to clearly disclose to customers that its service charges weren’t fully distributed to employees as tips, including what specific amount or percentage was distributed as tips.
