Case: Wage & Hour/Private Attorneys General Act (C.D. Cal.)

A federal district court granted in part and denied in part a motion for approval of a settlement under the California Private Attorneys General Act brought by a non-exempt retail employee against Kohl’s Department Stores, Inc., finding the $30,000 settlement for claims related to failure to provide suitable seating, proper rest periods, and reasonable temperature was fair and reasonable, but reducing the requested attorneys’ fees from one-third to 25% of the settlement amount due to lack of justification for exceeding the benchmark percentage.
