A federal district court granted in part and denied in part property managers’ motion for summary judgment for alleged violations of the Fair Labor Standards Act by Aspen Management USA for unpaid overtime wages. Despite its policy prohibiting overtime work without permission and the managers’ reasonable estimate of the amount and extent of overtime work performed that wasn’t reported on their timesheets, the court found that genuine issues of material fact exist as to whether Aspen had sufficient knowledge that the managers worked overtime and whether its alleged violation was willful.
