A kitchen manager may not proceed with his Fair Labor Standards Act and Pennsylvania Minimum Wage Act actions for unpaid overtime, but may go forward with his FLSA retaliation claim, against S.C. Boys, Inc., a federal district court in Pennsylvania ruled. He was allegedly terminated after making recurring complaints to management requesting overtime compensation. Because the kitchen manager earned at least $684 per week, managed as a primary duty, directed multiple employees’ work, and made suggestions as to hiring and firing, he wasn’t eligible for overtime pay under the FLSA, the court determined.
