Case: Wage & Hour/Overtime Exemption (S.D.N.Y.)

Feb. 25, 2020, 4:54 PM UTC

A former chef at a chain of New York restaurants may not proceed with his claim that the chain failed to properly compensate him for overtime, as required by the Fair Labor Standards Act and the New York Labor Law. He fell within the executive exemption to the FLSA’s requirements because his salary was over the threshold amount, he had a large number of managerial responsibilities, he supervised the kitchen staff, and he made recommendations about hiring and firing decisions. The case is Yeh v. Han Dynasty, 2020 BL 65883, S.D.N.Y., 18 Civ. 6018 (PAE), 2/24/20.
